FEDERALISM & DEMOCRACY – CHALLENGES & SOLUTIONS

Web Conference held on 12 December 2020

Introduction

Respectfully honoring the United Nations Declaration of Human Rights adopted on 10 December 1948, the Human Rights wing of the Naam Tamilar Katchi, observing the International Human Rights Day stands in solidarity will all oppressed individuals, societies, nationalities, regional identities and peoples across the globe.  Endorsing the right to self-determination of all peoples and nationalities, the Naam Tamilar Katchi reiterates its resolve to uphold this right enabling peoples to be masters of their own destiny.

Since the last 70 years, Indian rulers from different political parties have perpetuated the imperialistic structure and governance modules handed over to them by the British imperialists. Even though India adopted a constitution which was meant to be truly federal in nature to respect the rights of nationalities and regional identities, the working of the Indian polity over the decades has been totally in breach of the principle of federalism.

The Indian state has continued with some old British times draconian laws like preventive, detention, and sedition. India has framed laws like UAPA – Unlawful Activities Prevention Act, 1967 and continues to frame new anti-people legislations to convert India into a monolithic country under the “one nation, one language, one religion and one identity” principle of the right-wing forces.

Hundreds of political prisoners – prisoners of conscience are languishing in prison on trumped-up charges. Human rights defenders are being hounded. Students, lawyers, activists and leaders are defamed, charged, arrested and thrown into far-flung prisons.

The rights of states, mostly formed on linguistic lines are being undermined by the Union changing the federal structure by interference and intervention in subjects which are state subjects and using the brute majority in parliament to pass these draconian laws.

This year’s Human Rights Day theme relates to the COVID19 pandemic and focuses on the need to build back better by ensuring that human rights are central to all recovery efforts. India, unfortunately, has failed to maintain the constitutional rights of the people despite its quasi-federal structure. State governments have not been allocated enough funds to meet the gigantic problem of health unfolding in various parts of the country due to the pandemic.  Many countries, including India, in the face of the pandemic, have failed to uphold the principle of federalism whilst sharing funds for relief, health and rebuilding the economy.

International intervention and the right to self-determination have rarely been discussed areas in the Indian subcontinent, except by those whose rights have been trampled and are struggling to achieve them.

Understanding the state of Human Rights in South Asia, recognising the provisions of federalism enshrined in the Constitution of India and deeply concerned about the recent developments of violation of human rights in the region, this meeting unanimously adopts the following resolutions:

1. Saluting the farmers for their unprecedented 16-day struggle, which continues to gather strength with every passing day, this assembly of speakers and experts from across the globe acknowledge the contribution of the farmers and people of Punjab in forging and living up to the true concept of federalism by standing up for the rights of the states of the Indian Union.  We, unequivocally endorse all the demands of the Farmers Morcha.

2. This meeting emphasizes the need for reforms and change.  No law, rule, principle is definitive for all times.  As we all recognise the need for a federal structure, on the World Human Rights Day, we emphasize the need to revisit the entire gamut of the Indian constitution to attune it to the human rights, civil and political, social, economic and cultural rights of the peoples and nationalities, the ever-changing legal and social framework of world society, recognising the principles of inclusiveness, coexistence and tolerance at all levels. This is the road to a peaceful South Asia and the World, and we are all determined to stay committed this goal.

3. This assembly affirms that the true federal structure of the Constitution of India must be maintained and wherever required improvised upon to restore, protect and preserve the legitimate rights of the people. The federal structure, as envisaged by the framers of the Constitution of India should be respected and the items in the state list should not be moved to the Concurrent List and Union list.

4. Anti-People legislation like the Citizenship Amendment Act, the National Register of Citizens and the National Population Register, the New Education Policy, Environmental Impact Assessment, NEET Exams, Electricity Amendment Bill, the Farmers Produce Trade and Commerce (Promotion and Simplification) Act 2020, the Farmers (Empowerment and Protection) Agreement on Price Assurance and Agricultural Services Act 2020, the Essential Commodities (Amendment) Act 2020, the high-penalty imposing Stubble burning Ordinance – ‘Commission for Air Quality Management in National Capital Region and Adjoining Areas Ordinance 2020’, the Electricity Amendment Bill 2020, must be repealed immediately to restore the rights of farmers as well as honour the right of states to adjudicate upon this.

5. The already inefficient and insufficient health system of the states in India is under strain.  So, not only speaking generally but even with reference to health, there is a dire need to implement the provisions of federalism. The rights of the states to an equal share of funds to meet the COVID19 pandemic and its fallout on health and economy must be respected.  We urge the Indian government not to dilute federalism and restore the rights of states to protect the right to health of all states.

6. In a classic case of a State governor not honouring the judgement of the Supreme Court of India, the resolution of a State Assembly, the Tamil Nadu governor has stalled the release of 7 prisoners in the Rajiv Gandhi case, who have completed their jail terms. We seek their immediate and unconditional release.

7. Likewise, we seek the immediate and unconditional release of lawyers, student activists and others detained during the anti-CAA protests as well as those authors, pastors, human rights defenders and activists who have been detained in the Bhima Koregaon cases.

8. We condemn the measured silence of the Indian Union government on Mob Lynching of beef eaters and the ban on cow slaughter. The Right to Food of people of different ethnic and cultural backgrounds must be recognized and respected.

9. In recent years there has been an unprecedented growth of atrocities on Dalits, Adivasis and minorities. The union government should intervene immediately and protect the interests of these groups instead of being mute spectators and tacitly supporting the right-wing perpetrators of the attacks with the full connivance of the police and administrative machinery.

10. This forum strongly condemns the violation of the Instrument of the accession of Tripura and Nagaland and demands that the government prevent the ongoing colonisation of that region. The right to rule Tripura land must be given back to Twiprasa  (indigenous peoples of the region) and Nagaland to the Nagas. We must always preserve the land to protect the rights of indigenous people in all policies, strategies and interventions.

11. This forum strongly condemns the violation of the merger agreement of Assam to the Indian Union. Right to self-determination of Assam people and right of autonomy must be respected to protect their cultural and economic rights.

12. This forum recognizes the genocide of Tamils in Sri Lanka. We demand an impartial International Independent investigation into the acts of Genocide by the Sri Lankan armed forces and the politicians responsible for it. The structural genocide of Tamils must be stopped immediately. The North and the East of Sri Lanka must be demilitarized and the land grabbed from the Tamils restored to the rightful owners without delay. The Buddhisisation and Sinhalisation along with Sinhala Colonisation and population transfer of Sinhalese into Tamil areas must be stopped immediately.

13. While we unequivocally endorse the Right to Self-determination of Eelam Tamils, we demand that India recognize and take up the issue of the Right to Self Determination of the Tamils with the United Nations.

நமது அண்ணன் செந்தமிழன் சீமான் அவர்கள் கூறுவது போல், ‘நாம் வாக்குக்கானவர்கள் அல்ல அடுத்த தலைமுறையின் வாழ்க்கைக்கானவர்கள்‘ என்பதை மீண்டும் நிரூபித்த ஒவ்வொரு உறுப்பினர்களுக்கும் தகவல் தொழில் நுட்பப் பணியாளர்கள் பாசறை தனது நன்றியை உரித்தாக்குகிறது. இதேபோல் எதிர்வரும் ஒவ்வொரு சூழ்நிலையையும் நாம் ஒன்றிணைந்து எதிர்கொள்வோம் என்று நமது பாசறை உறுதி ஏற்கிறது.

இன்று 23-02-2020 ஞாயிற்றுக்கிழமை காலை 10 மணியளவில் காஞ்சிபுரம் மாவட்டம், கிழக்கு தாம்பரம், சி.எஸ்.ஐ. தேவாலயம் எதிரிலுள்ள அன்னை அருள் திருமண அரங்கத்தில் நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பிரிவு சார்பாக “சமூக ஊடக ஆர்வலர்கள் ஒன்றுகூடல்-2020” நிகழ்வு, தலைமை ஒருங்கிணைப்பாளர் சீமான் அவர்களின் தலைமையில் நடைபெற்றது.

இக்கூட்டத்தில் நிறைவேற்றப்பட்ட தீர்மானங்கள் பின்வருமாறு:

1. இந்திய அரசியலமைப்புச் சாசனத்தின் அடிநாதமாக விளங்கும் மதச்சார்பின்மை எனும் மகத்தான கோட்பாட்டினை அடியோடு தகர்த்து, நாடு முழுமைக்கும் வாழும் இசுலாமிய மக்களைத் தனிமைப்படுத்தி அச்சுறுத்தும் நோக்கோடு கொண்டு வரப்பட்டிருக்கிற குடியுரிமைச் சட்டத்திருத்தத்தை (CAA) நாம் தமிழர் கட்சி வன்மையாக எதிர்க்கிறது.
இச்சட்டத்திருத்தம் இந்திய நாட்டின் இறையாண்மைக்கும், பன்முகத்தன்மைக்கும் ஊறு விளைவிக்கும் கொடுஞ்சட்டமெனக் கண்டிக்கிறது. இதன் நீட்சியாக இருக்கிற தேசியக் குடிமக்கள் பதிவேட்டையும் (NRC), தேசிய குடிமக்கள் பதிவையும் (NPR) ஒருபோதும் கொண்டு வரக்கூடாது எனவும், நாடு முழுமைக்கும் போராடி வருகிற மக்களின் உணர்வுக்கு மதிப்பளித்து குடியுரிமைச் சட்டத்திருத்தத்தை உடனடியாகத் திரும்பப் பெற வேண்டும் எனவும் நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பாசறை வலியுறுத்துகிறது.

2. நாம் தமிழர் கட்சி முன்வைக்கிற ஆகச்சிறந்த கருத்தியலையும், அறம்சார்ந்த உயிர்மநேய அரசியலையும், ஒப்பற்ற உயர்நெறி கொள்கைகளையும் மக்களிடம் கொண்டு சேர்க்க அச்சு ஊடகங்களும், காட்சி ஊடகங்களும் தயங்கி நின்றபோது இணையத்தில் இயங்கும் கடைக்கோடி மகனுக்கும் கட்சியையும், அதன் கொள்கைகளையும் கொண்டு சேர்த்து மாற்று அரசியல் புரட்சிக்கு விதை தூவிடப் பேருதவி புரிந்தது சமூக வலைத்தளங்களில் இயங்கும் இனமானத்தமிழர்களென்றால் அது மிகையல்ல! வெறுமனே கேளிக்கைகளிலும், பொழுதுபோக்குகளிலும், அரட்டைகளிலும், வீணான விவாதங்களிலும் காலம் கழிக்காது இன விடுதலைக்கான ஊடகம் கட்டுகிற பெரும்பணியில் தங்களைப் பங்காளர்களாக ஈடுபடுத்திக்கொண்டு அயராது பணியாற்றி கட்சியின் கருத்தியலைக் கொண்டு சேர்த்திட தன்னார்வத்தோடு தொண்டு புரிந்த யாவருக்கும் நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப்பாசறை தனது நன்றிகளையும், வாழ்த்துகளையும் உரித்தாக்குகிறது.

3. 2021ஆம் ஆண்டு நடக்கவிருக்கிற தமிழகச் சட்டமன்றத் தேர்தலில் 234 தொகுதிகளிலும் தனித்துக் களமிறங்கும் நாம் தமிழர் கட்சி 117 தொகுதிகளில் ஆண்களையும், 117 தொகுதிகளில் பெண்களையும் களமிறக்கி புதிய அரசியல் வரலாறு படைக்கவிருக்கிறது. இத்தோடு, நாம் தமிழர் கட்சியின் ஆட்சியின் செயற்பாட்டு வரைவும் புதுப்பிக்கப்பட்டு, அதன் மேம்படுத்தப்பட்ட வடிவம் விரைவில் வெளியிடப்படவிருக்கிறது. அதுசமயம், கட்சியின் காலத்தேவையை வலியுறுத்தும்விதமாக தேர்தலுக்கான ஒருமித்த ஊடகப்பரப்புரையும், கட்டுக்கோப்பான ஒருங்கிணைவும் மிக அத்தியாவசியமாகிறது. அதற்காகத் தன்னார்வத்தோடு இணையத்தில் இயங்கும் கட்சியினரையும், கட்சியின் ஆதரவாளர்களையும் ஒருங்கிணைக்க வேண்டியதும், அதன்மூலம் வலிமைமிக்க பரப்புரைக்களத்தை உருவாக்க வேண்டியதும் இணையவெளியில் இயங்கும் ஒவ்வொருவரின் முதன்மைக்கடமையாகும். அதுசமயம், சமூக வலைத்தளங்களில் இயங்கும் ஒவ்வொருவரும் தங்கள் மூலம் குறைந்தது தலா 1,000 வாக்குகளையாவது பெற்றுத்தந்து கட்சியின் வெற்றிக்கு உழைக்க இந்நாளில் உறுதியேற்க வேண்டும் எனவும், இணையவெளியை ஆக்கப்பூர்வமாகப் பயன்படுத்தி நாம் தமிழர் கட்சியை அரியணையில் ஏற்றிட அயராது அரும்பாடாற்றி உழைக்க வேண்டும் எனவும் நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பாசறை அறைகூவல் விடுக்கிறது.

4. சென்னை மாநகராட்சிக்குட்பட்ட 24 அரசுப்பள்ளிகளில் பயிலும் ஐயாயிரத்திற்கும் மேற்பட்டப் பிள்ளைகளுக்கு காலை சத்துணவு வழங்கும் திட்டத்தைத் தொடங்கியிருக்கிற தமிழக அரசு, அதனை மதச்சார்பு கொண்ட ஒரு தனியார் அமைப்புக்குத் தாரை வார்த்திருப்பது வன்மையானக் கண்டனத்திற்குரியது. மதிய உணவு வழங்குவதை தமிழக அரசே தொய்வின்றி நடத்தி வரும் நிலையில் காலை உணவு வழங்கும் திட்டத்தை தனியார் நிறுவனத்திடம் வசப்படுத்துவது நிர்வாகச்சீர்கேட்டுக்கு வழிவகுக்கும் மிகமோசமான முன்னுதாரணமாகும். இது ஒட்டுமொத்தமாகப் பள்ளிகளில் உணவு வழங்கும் திட்டத்தையே தனியார்மயமாக்க முனையும் சதிச்செயலின் முன்நகர்வே! பள்ளிகளில் உணவு வழங்கும் இத்திட்டம் தனியாரிடம் ஒப்படைக்கப்பட்டால் அது ஏற்படுத்தப்பட்டதற்குரிய நோக்கமே முழுமையாக சிதைந்துபோகும் பேராபத்து நிறைந்திருப்பதால், அட்சயப் பாத்திரம் நிறுவனத்துடனான ஒப்பந்தத்தை தமிழக அரசு கைவிட வேண்டும் எனவும், காலை உணவு வழங்கும் திட்டத்தை அரசே ஏற்று செயற்படுத்த வேண்டும் எனவும் நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பாசறை வலியுறுத்துகிறது.

5. எளிய மக்களின் கருத்துகளைப் பிரதிபலிக்கும் ஊடகமாக, அடித்தட்டு மக்களின் அறச்சீற்றத்தையும், உள்ளக்குமுறலையும் வெளிக்காட்டும் பொதுவெளியாக இருக்கிற சமூக ஊடகங்களில் கருத்துகளைப் பகிர்வதையே முடக்கி, கருத்துச்சுதந்திரத்தின் குரல்வளையை நெரிக்கும் 66 ஏ சட்டப்பிரிவை உச்ச நீதிமன்றம் கடந்த 2015ஆம் ஆண்டு ரத்து செய்தபோதும் அப்பிரிவின் கீழ் நாடு முழுமைக்கும் வழக்குத் தொடுக்கப்பட்டு வருகிறது. இதுகுறித்து மாநில அரசாங்கங்கள் தங்களது காவல்துறையினருக்கு வழிகாட்ட உச்ச நீதிமன்றம் கடந்தாண்டு அறிவுறுத்தியும் அதனை மாநில அரசுகள் கடைப்பிடிக்காதிருப்பதும், ஆட்தூக்கிச் சட்டமான தேசிய முகாமைச் சட்டத்தில் (NIA) இணையக் குற்றங்களை உள்ளடக்கியிருப்பதும் சனநாயகத்தின் ஆணிவேரையே அசைத்துப் பார்க்கும் பேராபத்தாகும். இத்தோடு, இயல்பு நிலை திரும்பிவிட்டதாகக் கூறிவிட்டு, காஷ்மீரில் சமூக வலைத்தளங்களை முடக்கி வைத்திருப்பதும், அங்கு 3 ஜி மற்றும் 4 ஜி சேவையைப் பெற முடியா வண்ணம் தடுத்து வைத்திருப்பதும், வி.பி.என் சேவைகளைப் பயன்படுத்துவோரைக் கைதுசெய்வதும் காஷ்மீரிய மக்களை அடக்கி ஒடுக்கும் அரசப்பயங்கரவாதமாகும். ஆகவே, மக்களின் கருத்துரிமையைப் பறிக்கும் இக்கொடுஞ்செயல்களும், கொடிய சட்டங்களும் முழுமையாக விலக்கப்பட வேண்டும் என நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பாசறை வலியுறுத்துகிறது.

இன்று நடைபெற்ற கலந்தாய்வில் கீழ்கண்ட கருத்துக்கள் விவாதிக்கப்பட்டன.

நாம் தமிழர் கட்சியின் தகவல் தொழில்நுட்பப் பணியாளர்கள் பாசறையின் இரண்டாம் ஆண்டு துவக்கத்தின் முதல் கலந்தாய்வு இன்றைய தினம் தலைமை அலுவலகத்தில் சிறப்பாக நடந்து முடிந்தது.

நிகழ்விற்கு சிறப்பு அழைப்பாளராக வந்திருந்த நமது கட்சியின் தலைமை செய்தி தொடர்பாளர் அண்ணன் திரு. சே.பாக்கியராசன் அவர்கள் நமது பாசறையின் சென்ற ஆண்டிற்கான ஆண்டு மலர் -2019 ஐ வெளியிட்டு சிறப்புரையாற்றினார்.

இன்றைய தினம் நமது பாசறையின் புதிய பொறுப்பாளர்கள் அறிமுக நிகழ்வும், எதிர்கால செயல்திட்ட விளக்கமும், உறுப்பினர்கள் கருத்துப்பரிமாற்றம் மற்றும் கலந்தாய்வும் மிகவும் ஆக்கபூர்வமாக நடந்து முடிந்தது.

இன்றைய கலந்தாய்வில் கலந்துகொண்ட அனைத்து உறவுகளுக்கும் நன்றியை தெரிவித்துக்கொள்கிறோம்.  

 

 

 

குடியுரிமைத் திருத்தச் சட்ட மசோதா மற்றும் நாடு முழுவதும் கொண்டு வரப்படவுள்ள தேசிய குடியுரிமைப் பதிவேடு சனநாயகத்திற்கு எதிரானதென நாம் தமிழர் கட்சி தெரிவித்துள்ளது.

காசுமீரில் நடக்கும் வன்முறைகளை கண்டிப்பதோடு பல்வந்த்சிங் ரஜோனாவுக்கு விதிக்கப்பட்டுள்ள தூக்குத் தண்டனையை ரத்து செய்ய வேண்டுமெனவும் நாம் தமிழர் கட்சி வலியுறுத்துகிறது.

இந்த கருத்தரங்கில் தகவல் அறியும் உரிமைச் சட்டம் குறித்து மனித உரிமை ஆர்வளரும், டெல்லி உச்சநீதிமன்ற வழக்கறிஞருமான திரு.பாரிவேந்தன் அவர்கள் கலந்துரையாடினார். சென்னை உயர் நீதிமன்ற வழக்கறிஞரான திரு.ராஜீவ்காந்தி அவர்கள் இந்திய அரசியலமைப்புச் சட்டத்தில் சொல்லப்பட்டுள்ள அடிப்படை உரிமைகள் குறித்த விவரித்தார். கல்வி உரிமைச் சட்டம் மற்றும் புதிய கல்விக்கொள்கை குறித்து கல்வியாளர் பேராசிரியர் திரு.கல்யாணசுந்தரம் அவர்கள் எடுத்துரைத்தார்.

நாம் தமிழர் கட்சியின் தகவல் தொழில் நுட்பப் பணியாளர்கள் பாசறையின் சார்பில் டிசம்பர் 8 2019 ஞாயிறன்று ஏற்பாடு செய்யப்பட்டிருந்த இந்நிகழ்வில் மனித உரிமை ஆர்வளர்களும், நாம் தமிழர் கட்சியினரும் பெருமளவில் கலந்து கொண்டனர். அப்பாசறையின் பொறுப்பாளர்களான திரு.மதுசூதனன், திருமதி. சிவசங்கரி ஆகியோர் இந்நிகழ்வை ஒருங்கிணைத்தனர்.

சர்வதேச மனித உரிமைகள் தினக் கருத்தரங்கின் இறுதியில் கீழ்க்கண்ட தீர்மானங்கள் ஒருமனதாக நிறைவேற்றப்பட்டன.

தீர்மானம் 1: குடியுரிமைச் சட்ட திருத்த வரைவு மசோதா 

பிறநாட்டு மதச்சிறுபான்மை ஏதிலிகளைப்  பாதுகாக்கிறோம் எனும் பெயரில் அரசியலமைப்புச் சட்டத்தின் அடிப்படையையே தகர்க்கும் வண்ணம் இந்திய ஒன்றிய அரசு கொண்டு வரும் மத அடிப்படையிலான குடியுரிமைச் சட்டத்தை வன்மையாகக் கண்டிப்பதுடன், இந்தியாவிலுள்ள இலங்கையைச் சார்ந்த மதச்சிறுபான்மையினரான ஈழத்தமிழர்களை இந்தச் சட்டத்திருத்தத்தின் கீழ் கொண்டு வராததின் அடிப்படையில் தமிழர்கள் இந்துக்கள் அல்ல என்பதை இந்திய ஒன்றிய அரசு ஏற்றுக்கொள்கிறது என்பதையும்  இந்த அவை சுட்டிக்காட்ட விரும்புகிறது.

தீர்மானம் 2: தேசிய குடியுரிமைப் பதிவேடு 

இந்திய ஒன்றிய அரசு நாடு முழுமைக்கும் கொண்டு வரத் திட்டமிடும் தேசியக் குடியுரிமைப் பதிவேட்டின் மூலம் இலட்சக்கணக்கான மக்களை நாடற்றவர்களாக மாற்றும் மனிதாபிமானமற்ற திட்டத்தை இந்த அவை வன்மையாகக் கண்டிக்கிறது.

தீர்மானம் 3: காசுமீரில் நடைபெறும் மனித உரிமை மீறல்கள் 

காசுமீரில் நடைபெறும் மனித உரிமை மீறல்களை இந்த அவை வன்மையாகக் கண்டிப்பதுடன், காசுமீர் மக்கள் அவர்களின் சொந்த மண்ணில் சுதந்திரமாக அனைத்து உரிமைகளையும் பெற்று நிம்மதியாக வாழச் சர்வதேசச் சமுதாயம் குரல் கொடுக்க வேண்டுமென இந்த அவை கேட்டுக் கொள்கிறது.

தீர்மானம் 4: பல்வந்த் சிங் ரஜோனாவின் தூக்குத்தண்டனையை ரத்து செய்தல்

எப்பொழுது வேண்டுமானாலும் தூக்கிலிடப்படலாம் என்ற நிலையில் கடந்த 24 ஆண்டுகளாகச் சிறையில் வாடும் சீக்கியர் பல்வந்த் சிங் ரஜோனாவுக்கு மனிதாபிமான அடிப்படையில் அத்தூக்குத் தண்டனையை உடனடியாக ரத்து செய்து ஆயுள் தண்டனையாகக் குறைக்க நடவடிக்கை எடுக்குமாறு இந்திய ஒன்றிய அரசையும், பஞ்சாப் மாநில அரசையும்  இந்த அவை வற்புறுத்துகிறது.

தீர்மானம் 5: 29 ஆண்டுகளாக சிறையில் வாடும் எழுவரை விடுதலை செய்தல்

ஆயுள் தண்டனை பெற்று 29 ஆண்டுகளாகச் சிறையில் உள்ள  முருகன், நளினி, சாந்தனு, பேரறிவாளன், ஜெயக்குமார், ராபர்ட் பயஸ், ரவிச்சந்திரன் ஆகிய 7 தமிழர்களை இனிமேலும் காலம் தாழ்த்தாமல் அரசியலமைப்புச் சட்டத்தின் 161-ஆவது பிரிவின் படி தமிழ்நாடு அரசின் அமைச்சரவை நிறைவேற்றி அனுப்பிய தீர்மானத்தை ஏற்று அவர்களை உடனே விடுதலை செய்யுமாறு தமிழ்நாடு ஆளுநரையும், இந்திய ஒன்றிய அரசையும் இந்த அவை வலியுறுத்துகிறது.

தீர்மானம் 6: மனித உரிமைப் போராளி கிலானி மறைவுக்கு இரங்கல்

சிறைவாசிகளின் உரிமைகள் பாதுகாப்புக் குழு என்ற அமைப்பை உருவாக்கிப் போராடி வந்த மனித உரிமைப் போராளி பேராசிரியர் சையது அப்துல் ரஹ்மான் கிலானி அவர்களின் மறைவு மனித உரிமை போராட்டக் களத்திற்கான பேரிழப்பு என்பதை இந்த அவை வருத்தத்துடன் பதிவு செய்கிறது.

தீர்மானம் 7: தமிழ்நாடு அரசு  அனைத்து அரசியல் கைதிகளையும் விடுவிக்கக் கோருதல்

நீண்டகாலமாகத்  தமிழகச் சிறைச்சாலைகளில் தடுத்து வைக்கப்பட்டுள்ள தமிழ் அரசியல் கைதிகள் உடனடியாக விடுதலை செய்யப்பட வேண்டுமென இந்திய ஒன்றிய அரசையும், தமிழ்நாடு அரசையும் இந்த அவை கோருகிறது.

தீர்மானம் 8:ஈழத்தமிழர்கள் கவலையுறும் இலங்கையின் தற்போதைய அரசியல் சூழல்

தமிழீழத்தில் நடைபெற்ற இனப்படுகொலையை முன்னின்று நடத்திய கோத்தபய ராஜபக்சே இப்போது இலங்கையின் புதிய அதிபராகப் பதவியேற்றுள்ள நிலையில் அங்கு வாழும் ஈழத்தமிழர்கள் எவ்வித அச்ச உணர்வுமின்றி சுதந்திரமாக வாழும் நிலையை ஏற்படுத்திடச் சர்வதேசச் சமூகம் உதவுமாறு இந்த அவை கேட்டுக் கொள்கிறது.

தீர்மானம் 9: குடியுரிமைச் சட்டத் திருத்த வரைவு மசோதாவில் விடுபட்டுள்ள ஈழத்தமிழர்கள்

குடியுரிமைச் சட்டத் திருத்த மசோதாவில் ஒரு புறம் இசுலாமிய ஏதிலிகளை அவர்களின் சொந்த நாட்டில் மதப்பெரும்பான்மையினர் என்ற அடிப்படையில் அவர்களைப் புறக்கணித்து அநீதி இழைத்துள்ள இந்திய ஒன்றிய அரசு மறுபுறம் இலங்கையின் சிறுபான்மை மதமான இந்துக்களாக அடையாளப்படுத்தப் பட்டுள்ள ஈழத்தமிழர்களையும் புறக்கணித்துள்ள இந்திய ஒன்றிய அரசின் இரட்டை வேடத்தை தமிழ்நாட்டிலுள்ள அனைத்துக் கட்சிகளும் கண்டிக்க வேண்டுமென இந்த அவை கோரிக்கை விடுக்கிறது.

தீர்மானம் 10: சென்னை உயர்நீதிமன்றத்தின் வழக்காட்டு மொழியாகத் தமிழ்

இந்திய அரசியலமைப்புச் சட்டத்தின் பிரிவு 348 (2)ன் படியும், ஆட்சி மொழிச் சட்டத்தின் 7 வது பிரிவின் படியும் தமிழைச் சென்னை உயர்நீதிமன்றத்தின் வழக்காடு மொழியாகக் கொண்டு வர மேலும் காலம் தாழ்த்தாமல் உடனே நடவடிக்கை எடுக்குமாறு இந்திய ஒன்றிய அரசையும், தமிழ்நாடு அரசையும் இந்த அவை கேட்டுக்கொள்கிறது.

தீர்மானம் 11: மேட்டுப்பாளையத்தில் தீண்டாமைச் சுவர் இடிந்து உயிரிழந்த 17 அப்பாவிகள்

கோவை மாவட்டம் மேட்டுப்பாளையத்தில் தீண்டாமைச் சுவர் இடிந்து விழுந்து 17 அப்பாவி ஏழைகள் உயிரிழந்ததற்குக் காரணமானவர்களைச் சட்டத்தின் முன் நிறுத்தி கடுமையான தண்டனையைப் பெற்றுத் தருவதோடு மேற்கொண்டு இதனைப் போன்ற அசம்பாவிதங்கள் நேரா வண்ணம் தகுந்த நடவடிக்கைகளை உடனே எடுக்குமாறு தமிழ்நாடு அரசை இந்த அவை கேட்டுக்கொள்கிறது.

தீர்மானம் 12: சர்வதேசச் சட்டங்களின் அடிப்படையில் ஈழ ஏதிலிகளை நடத்தக் கோருதல்

இந்திய ஒன்றியத்தில் நீண்ட காலமாகத் தஞ்சமடைந்துள்ள ஈழத்தமிழர்களின் உரிமைகள் அனைத்தும் ஏதிலிகளுக்கான பன்னாட்டுச் சட்டங்களுக்கு ஏற்ப இந்திய ஒன்றிய அரசு, மாநில அரசுகளால் வழங்கப்பட்டு இந்தியாவில் வாழும் ஏனைய நாட்டு ஏதிலிகள் போல் அங்கீகரிக்கப்பட வேண்டுமென இந்த அவை வலியுறுத்துகிறது.

தீர்மானம் 13: கல்வியை மாநிலப் பட்டியலுக்குக் கொண்டு வருதல்

இந்திய ஒன்றியம் முழுமைக்கும் ஒரே பாடத்திட்டத்தைக் கொண்டு வருவதையும், ஆரம்பக் கல்வியிலேயே பொதுத் தேர்வுகளை அறிமுகப்படுத்துவதையும்  கைவிடுமாறும், கல்வியை பொதுப் பட்டியலில் இருந்து மாநிலப் பட்டியலுக்கு மாற்றுமாறும் இந்திய ஒன்றிய அரசை இந்த அவை வற்புறுத்துகிறது.

தீர்மானம் 14: பாலியல் குற்றவாளிகளுக்கு விரைவாக தண்டனையும், பாதிக்கப்பட்டோருக்கு பாதுகாப்பும்.

பெண்கள் மற்றும் குழந்தைகளுக்கு எதிரான பாலியல் குற்றங்கள் புரிந்த குற்றவாளிகளை விரைவு நீதிமன்றங்கள் அமைத்து உடனடியாக அதிகபட்ச தண்டனை பெற்றுத் தர வேண்டும் என்று வலியுறுத்துகிறோம்.

பாலியல் வன்கொடுமைக்கு உள்ளான பெண்களுக்கு குற்றத்தில் ஈடுபட்ட குற்றவாளிகளால் எவ்வித பாதிப்பும் நேராத வகையில் தகுந்த பாதுகாப்பு அளித்திட இந்திய ஒன்றிய அரசையும் மற்றும் மாநில அரசையும் வலியுறுத்துகிறோம்.

 

CAB and NRC are unconstitutional says NTK on World Human Rights Day

NTK activists condemn rights violations in Kashmir and seek commutation of death sentence to Balwant Singh Rajoana

On the eve of the International Human Rights Day 2019, Naam Tamilar Katchi organised a special Human Rights conference, which was attended by activists from across the state. Human Rights activist and Supreme Court lawyer Mr. Pariventhan dwelt on the use of the Right to Information Act. Chennai High Court lawyer Mr. Rajivgandhi spoke about Constitutional rights and educationist Professor Kalyanasundaram emphasized the importance of Right to Education and the demerits of the new National Education Policy.

Human rights activists and Naam Tamilar Katchi cadres participated in the event organised by the IT Employees Wing of the Naam Tamilar Katchi, Mr. Madhusudhanan and Ms.Sivasankari coordinated the event.

Observing International Human Rights Day on 8 December 2019, after due deliberations, the following resolutions were unanimously adopted:

Resolution 1: Citizenship Amendment Bill

Naam Tamilar Katchi strongly condemns the religion-based Indian Citizenship Amendment Bill proposed ostensibly to protect refuges from religious minority communities. NTK denounces this move which will dismantle the very foundations of the Constitution of India. The party notes with concern that the Indian Union government is accepting the fact that Tamils are not Hindus by excluding Eelam Tamils, who are a religious minority in Sri Lanka, from the bill.

Resolution 2: National Register for Citizenship

NTK believes that the Citizenship Amendment Bill is a precursor to the National Register for Citizenship (NRC), which is a dangerous move likely to culminate in making lakhs of peoples as refugees in their own country. NTK warns the government of serious consequences if CAB and NRC are hastily implemented.

Resolution 3: Human Rights Violations in Kashmir

Naam Tamilar Katchi strongly condemns the continuing human rights violations in Kashmir. NTK demands that all kinds of embargo on the life of Kashmiris must be removed and the Kashmiri leadership and activists must be released from prisons. NTK hopes that the international community will play an effective role in ensuring that the Kashmiris’ rights to live a free and peaceful life in their homeland is fully respected.

Resolution 4: Commute Death sentence of Balwant Singh Rajoana

We urge the government of India to commute the death sentence of Balwant Singh Rajoana -a Sikh who has been suffering in prison, waiting to be hung, for the past 24 years, to a lifetime sentence on humanitarian grounds.

Resolution 5: Release 7 individuals who are in prison for 29 years

Having been sentenced to life imprisonment, the seven Tamils, Murugan, Nalini, Santhanu, Perarivaalan, Jayakumar, Robert Payas and Ravichandran, have remained imprisoned for the past 29 years. On the occasion of International Human Rights Day, when the whole world is talking about upholding human rights, NTK reiterates that it is time to talk of prisoner rights as well. NTK urges the governor of Tamil Nadu and the Indian Union government to release them without any further delay by accepting the resolution passed by the Tamil Nadu state assembly under Article 161 of the Constitution of India.

Resolution 6: Homage to Kashmiri human rights activist SAR Geelani

This gathering of human rights defenders pays homage to the late human rights activist Sayed Abdul Rahman Geelani – the lone voice of Kashmiri rights, who was also the founder of Committee for Protection of Prisoner Rights and registers with a heavy heart that his demise is a great loss for human rights activism.

Resolution 7: Tamil Nadu urged to release all political prisoners

This meeting appeals to the Indian government and the Tamil Nadu government to immediately release all Tamil political prisoners who have been imprisoned for a long time.

Resolution 8: Sri Lanka situation cause for concern for Eelam Tamils

This house observes that the election of Gotabaya Rajapaksa as President of Sri Lanka, who led the genocide of Tamils in Tamil Eelam, is a testing time for Eelam Tamils in the island country. The IT Employees wing of the Naam Tamilar Katchi appeals to the international community to create an environment for the Tamils in Sri Lanka, where they can live freely without any fear.

Resolution 9: NTK questions CAB for not including Eelam Tamils

NTK notes with concern the dichotomy in the Indian stand on foreign refugees in the CAB. On the one hand the government of India has done grave injustice by not including the Muslims, on the other hand even Eelam Tamils, who are perceived as Hindus by the Indian state and who are a religious minority in Sri Lanka facing gross persecution, is also not included. The party called upon all Tamil political parties to condemn this move.

Resolution 10: Implement Tamil as official language of Chennai High Court

As the process of making Tamil as the official language of the Chennai High Court, along with English is nearly completed, the Indian government and the Tamil Nadu government must act to implement Tamil as a language of the Chennai High court with immediate effect as per the article 348(2) in the Constitution of India and section 7 of the Official Languages Act, 1963.

Resolution 11: Punish guilty and award exemplary compensation to Mettupalayam wall collapse victims

17 innocent and marginalized people were killed in a wall collapse in Mettupalayam, Coimbatore. We demand that responsibility must be fixed and the guilty punished and also take steps to prevent such incidents from happening again. NTK also demands that exemplary compensation must be given to those who died in the incident.

Resolution 12: Recognize Eelam Tamils as refugees as per international covenants and treaties

This meeting appeals to the Indian Union government and the Tamil Nadu government that Eelam Tamils who took refuge in Tamil Nadu and are living in the Indian Union for a long time, shall be given all the rights as per International Refugee covenants and treaties and be recognized like refugees from any other country living in the Indian Union.

Resolution 13: Place Education on State List

This house insists the Indian Union government withdraw the proposed changes to the education policy that introduces a common curriculum for the entire Indian Union and public exams in primary education. It also demands that Education be placed on the state list by removing it from the concurrent list.

Resolution 14: Prompt punishment for offenders of sexual crime and protection for victims.

We urge to set up special courts to probe sexual offenses against women and children and maximum punishment immediately.

We urge the Union Government of India and the State Government to provide adequate protection to the victims of sexual harassment from the perpetrators of crime.

 

 

இன்று நடைபெற்ற கலந்தாய்வில் கீழ்கண்ட கருத்துக்கள் விவாதிக்கப்பட்டன.

* 12 & 13 அக்டோபர் தேதிகளில் விக்கிரவாண்டி சட்டமன்ற இடைத் தேர்தல் பரப்புரையில் நமது பிரிவின் சார்பாக கலந்து கொண்ட அனைத்து உறவுகளுக்கும் நன்றி தெரிவிக்கப்பட்டது.

* வாய்ப்புள்ள அனைத்து உறுப்பினர்களையும் நாம் தமிழர் கட்சியின் துளி திட்டத்தில் இணைந்து கட்சியின் பொருளாதாரத்தை வலுப்படுத்த உறுதுணையாகஇருக்குமாறு தீர்மானம் நிறைவேற்றப்பட்டது.

* தமிழில் பெயர் பலகை வைப்பது குறித்து விழிப்புணர்வு ஏற்படுத்த அரசுக்கு மனு தயாரித்து சமர்ப்பிக்க முடிவு செய்யப்பட்டது.

* தமிழில் பெயர் பலகை வைக்க வியாபார நிறுவனங்களை கோர தேவையான துண்டறிக்கைகள் மற்றும் ஆயத்த வேலைகளை தொடங்க முடிவு செய்யப்பட்டது.

* கூகுள் மேப் மற்றும் இதர செயலிகளில் வியாபார நிறுவனங்கள் பற்றி விமர்சனம் எழுதும் இடத்தில் பிரபல வியாபார நிறுவனங்களின் பெயரை தமிழில் மாற்றம் செய்ய கோரிக்கை வைக்க முடிவு செய்யப்பட்டது.

* நமது பிரிவில் உள்ள உறுப்பினர்களை உள்ளாட்சித் தேர்தலில் வாய்ப்பு இருக்கும் பட்சத்தில் போட்டியிடுமாறு கேட்டுக்கொள்ளப்பட்டது.

* உள்ளாட்சித் தேர்தலில் குறிப்பிட்ட இடங்களில் நமது உறுப்பினர்களையோ அல்லது நமது கட்சியை சார்ந்த மற்ற வேட்பாளர்களையோ ஆதரித்து பரப்புரை மேற்கொள்ள முடிவு செய்யப்பட்டது.

* செங்கொடி நினைவு பள்ளியில் கள ஆய்வு செய்து அவர்களுக்கு தேவையான உதவிகளை செய்ய திட்டம் தீட்ட முடிவு செய்யப்பட்டது.

* தற்சார்பு பொருளாதாரத்தில் தகவல் தொழில்நுட்ப பணியாளர்களுக்கான வேலைவாய்ப்பு எனும் தலைப்பில் ஆவனம் தயார்செய்யும் உறுப்பினருக்கு உதவி செய்ய முடிவு செய்யப்பட்டது.

* நமது பிரிவின் அறிவிப்புகளை வெளியிட ட்விட்டர் செயலியில் கணக்கு தொடங்க முடிவு செய்யப்பட்டது.

* நாம்தமிழர் பிரிட்டானியா பிரிவின் சார்பாக உருவாக்கப்பட்டுள்ள செயலியை நடைமுறைக்கு கொண்டு வர தகவல் தொழில்நுட்ப பிரிவுக்கு உதவி தேவைப்படின் செய்ய முடிவு செய்யப்பட்டது.

அக்டோபர் 02, 2019 அன்று கட்சி தலைமையகத்தில் நடைபெற்ற கலந்தாய்வின் முடிவுப்படி, விக்கிரவாண்டி இடை தேர்தலுக்கான பரப்புரை நமது பாசறையின் உறுப்பினர்களால் அக்டோபர் 12 & 13 தேதிகளில் வேட்பாளர் கந்தசாமி அவர்களுடன் இணைந்து விக்கிரவாண்டி மற்றும் அதன் சுற்றுப்பகுதி கிராமங்களில் மிகச்சிறப்பாக மேற்கொள்ளப்பட்டது.

அக்டோபர் 12 & 13 விக்கிரவாண்டி தேர்தல் பிரச்சாரத்தில், தகவல் தொழில்நுட்ப பணியாளர்கள் பிரிவின் சார்பில் பங்கேற்பது குறித்து திட்டமிடலுக்கான கலந்தாய்வு இன்று (அக்டோபர் 02, 2019) நமது கட்சி அலுவலகத்தில் நடைபெற்றது. பிரச்சாரத்தில் பங்கேற்க விருப்பம் தெரிவித்த நபர்கள் இதில் கலந்து கொண்டனர்.

  வீரத்தமிழர் முன்னணி சார்பில் தஞ்சையில் விரைவில் நடைபெறவுள்ள அருண்மொழி சோழன்(ராச ராச சோழன்) பேரரசன் பெருவிழாவை மிகச்சிறப்பாக நடத்துவது குறித்த கலந்தாய்வு, அண்ணன் சீமானின் முன்னிலையில் இன்று காலை 11 மணியளவில் அன்னை அருள் திருமண அரங்கம், கிழக்கு தாம்பரத்தில் நடைபெற்றது. இக்கலந்தாய்வில் நமது பிரிவு உறுப்பினர்கள் கலந்து கொண்டனர்.

    மேலும் நமது பிரிவு உறுப்பினர்களிடம் திரட்டப்பட்ட நிதி ரூ 25,000 /- நமது பிரிவின் சார்பில் வீரத்தமிழர் முன்னணி பொறுப்பாளர்களிடம் நன்கொடையாக ஒப்படைக்கப்பட்டது.
